Reporting of illegal actions
CHAPS spol. s.r.o. on the basis of Act No. 171/2023 Coll., on the protection of whistleblowers, it has introduced an internal notification system for receiving notifications of possible illegal acts.
Any natural person (whistleblower) who has information about a possible illegal act that has occurred or is about to occur with a person for whom the informant performed or performs work or another similar activity, or with a person, can file a notification about an illegal act with which the informant was or is in contact in connection with the performance of work or other similar activities and which:
- has the characteristics of a crime,
- has the features of a misdemeanor for which the law sets the rate of the fine, the upper limit of which is at least CZK 100,000,
- violates the Whistleblowing Act, or
- violates another legal regulation or a regulation of the European Union.
What should the notice contain?
The notification should primarily contain information about a possible illegal act, its detailed and coherent description, as well as the identification of persons suspected of such illegal act. Such information is absolutely crucial for the subsequent procedure of the person concerned, so that he can assess in a relevant way the reasonableness of such notification.
We would like to point out that a knowingly false report can be qualified as a misdemeanor by law, for which a fine of up to CZK 50,000 can be imposed. At the same time, a whistleblower who makes a knowingly false report is not protected by law against retaliation.
Where can I file a notice?
Notification can be submitted by the whistleblower through our internal notification system as follows:
- via secure e-mail: oznamovatel@chaps.cz
To report a possible illegal act, the whistleblower can also use the external notification system of the Ministry of Justice available on the website https://oznamovatel .justice.cz/chci-podat-oznameni/.
Who is the relevant person?
A competent person is a person authorized by our company to receive notifications, assess the reasonableness of a notification submitted through the internal notification system, and propose measures to correct or prevent an illegal situation. This person proceeds impartially in the performance of his/her work and maintains confidentiality about the facts he/she learns about in the performance of his/her work, even after it has ended.
In our company, the persons in charge of receiving and processing notifications are Mgr. Jan Mučka, lawyer and Mgr. Milan Jelínek, lawyer. To contact them, please use our internal notification system as described above.
